Simply Headsets Ask Us What We’re Wearing 2024 - Terms and Conditions

This competition is run by Simply Headsets. The Competition is administered in Australia. Therefore, Australian law exclusively applies to the Competition regardless of the location of the individual participant.

By entering the competition, you will be bound by these terms & conditions, and you acknowledge that you satisfy all eligibility requirements. This competition is limited to retail purchases carried out via Simply Headsets https://www.simplyheadsets.com.au/ask-us-what-we-are-wearing during the promotion period by Australian Residents only. Purchases from overseas are ineligible. The Tax Invoice must list the Simply Headsets’ Australian Business Number (ABN) of the Seller and the GST amount.

Purchasing a Yealink product during this promotion does not constitute a guarantee of being awarded a prize Competition. Simply Headsets reserves the right to withdraw or change this offer at any time, without prior notice.

1. ELIGIBILITY OF PARTICIPANT

1.1 The Competition is available to end-customers of Simply Headsets from 1 February 2024 - 29 February 2024 and the eligible participants must purchase any Yealink product during this period, provided that the participant is at least 18 years of age. Employees of Simply Headsets and their relatives are excluded from participation in the Competition.

1.2 Simply Headsets reserves the right, upon its sole discretion, to exclude participants on valid grounds, such as but not limited to:

violation of the rules of the Competition;

manipulation of the technical process or administration of the Competition;

undue conduct; or

false or misleading statements regarding participation in the Competition.

1. PROCEDURE OF THE COMPETITION

2.1 To enter the Competition the participants need to purchase any Yealink product from the reseller Simply Headsets during the promotion period from  February 2024 - 29 February 2024, the end-user will be eligible for entering the prize draw. For every unit of Yealink product purchased from the reseller Simply Headsets during this period, the end-user will receive one ticket for the prize draw. Purchasing specially marked Yealink products highlighted on https://www.simplyheadsets.com.au/ask-us-what-we-are-wearing during the promotion will receive two tickets for the prize draw. Only the end-user who fully and completely meet the promotion requirements including buying Yealink products from Simply Headsets during the promotion period will be eligible to enter the prize draw.

2.2 One eligible participant will be randomly selected as winner on 17 February 2024. Each unit of Yealink product purchased corresponds to one ticket in the prize draw, with Yealink products marked on https://www.simplyheadsets.com.au/ask-us-what-we-are-wearing will receive two tickets for the prize draw. Winning participants will be contacted via email within ten days following the end date of the Competition. 

1. COMPETITION COMPETITION PERIOD

3.1 The competition will begin 1 February 2024 and will end on 29 February 2024.

1. PRIZES

4.1 There will be four winners in total being awarded with one $500 gift card each for clothes shopping. The same customer cannot win more than one card. These gift cards will be valid for 3 years, and can be redeemed at the following clothing stores (both in store and online) in Australia: Kmart, Target, JayJays, Big W, City Beach, Shein, ICONIC, Just Jeans, CUE, Veronika Maine, Culture Kings, Peter Alexander, Dotti, Sportscraft, Portmans, ASOS, Gorman, General Pants, Seed, Country Road, Witchery, Forever New, French Connection, Princess Highway, Dangerfield, Glassons, Saba, H&M, ShowPo, Best and Less. Review, Black Pepper, Russell Athletic, Mitch Dowd, Bonds, Lorna Jane, Maison deSabre, Status Anxiety, Oodie, Trenery, JAG, Beginning Boutique.

4.2  If a prize is not accepted by the prize winner, or if the prize winner does not respond within a specified timeframe, the prize will be redrawn and awarded to another random participant. All prizes must be accepted as awarded and may not be transferred, substituted or redeemed for cash or otherwise.

4.3 Prizes are offered "as is" with no written, express, or implied warranty.

4.4 The winners of the merchandise prizes will be drawn on February 17th, 2024.

1. DATA PRIVACY

5.1 Simply Headsets will be collecting personal data about participants, in accordance with its privacy notice. Please review Simply Headsets’ privacy notice at https://www.simplyheadsets.com.au/privacy-policy/. By participating in the Competition, each participant hereby agrees to Simply Headsets’s collection and usage of his/her personal information for the purpose of the Competition as set out herein and acknowledges that he/she has read and accepted Simply Headsets’ privacy notice.

1. LIMITATION OF LIABILITY

6.1 To the extent permitted by law, Simply Headsets is not responsible for:

Any incorrect or inaccurate information associated with or utilised in the Competition;

technical failures of any kind including, but not limited to malfunctions, interruptions or disconnections in phone-lines or network, hardware or software;

unauthorised human intervention in any part of the Competition

technical or human error which may occur in the administration of the Competition, or

any injury or damage to persons or property which may be caused directly or indirectly, in whole or in part from participants participation in the Competition.

6.2 Simply Headsets is responsible for prize availability, but not for prize utility or quality or otherwise.

6.3 The reporting and payment of any taxes on prizes, if necessary, are the sole responsibility of the winner.

1. REVOCATION, TERMINATION AND WITHDRAWAL

7.1 Participants may withdraw from the Competition at any time by emailing Simply Headsets. Within reasonable time upon notification, Simply Headsets will delete all data collected from the participant. Participants may declare their withdrawal at any time to Simply Headsets.

7.2 Revocation of the right to use participant’s personal data is possible at any time. However, such revocation will necessarily be followed by the exclusion of the participant from the Competition.

7.3 Simply Headsets reserves the right to cancel or end the Competition at any time, without notice or reason.

1. APPLICABLE LAW AND JURISDICTION

8.1 The Competition is governed by and construed in accordance with Australian law, excluding its conflict of law rules. Any disputes arising under the Competition will be settled by the Australian courts.

1. MISCELLANEOUS

 9.1 The invalidity or unenforceability of any provision of these terms and conditions will not affect the validity or enforceability of any other provision. In the event that any provision of the terms and conditions is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

9.2 Simply Headsets’ failure to enforce any term of these terms and conditions will not constitute a waiver of that provision.
